Acceptance of these Terms and Conditions does not affect your statutory rights as a consumer.

1. CONTRACT

By using this website you accept these Terms and Conditions in full. If you disagree with any part of these Terms and Conditions, do not use this website.
When you place an order to purchase a product from ShipWrightShop.com, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we have dispatched that product to you (the "Dispatch Confirmation E-mail"). That acceptance will be complete at the time we send the Dispatch Confirmation E-mail to you. Any products on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.

2. PRICES

Despite our best efforts, a small number of the products in our catalogue may be incorrectly priced; however, we verify prices as part of our dispatch procedures. If a product's correct price is lower than our stated price, we charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.

3. AVAILABILITY

An item's availability is the estimated time it will take us to get it, pack it and prepare it for dispatch. We endeavour to dispatch all orders within 3 working days, stock levels permitting.
Despite our best efforts, from time to time some items do temporarily run out of stock. If your order contains an item(s) that are out of stock, we will, at our discretion, wait until all items are in stock before processing your order or send the in stock items to you with the out of stock items to follow at a later date - you will not be charged extra P&P for this.
To keep you fully informed of the progress of your order, we will send you one e-mail when we receive it and another when we dispatch it (the "Dispatch Confirmation E-mail"), confirming the date, contents and method of delivery.

4. CUSTOMS

When ordering goods from ShipWrightShop.com for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from ShipWrightShop.com, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.
Also, we may provide certain order, delivery and product information, such as titles, to our international carriers and such information may be communicated by the carriers to customs authorities in order to facilitate customs clearance and comply with local laws.
We cannot accept returns for non payment of customs clearance charges import duties or taxes.

5. PAYMENT

All prices and payment are in pounds sterling.
We accept Visa, MasterCard & Maestro (switch / solo) cards. For alternative payment options please contact us on sales@shipwrightshop.com.
We do not take payment for any goods until they are ready for dispatch.

6. QUALITY AND SUITABILITY

We endeavour to supply the best quality of goods available. Customers should be aware that the model kits supplied by ShipWrightShop.com can be difficult to build and require a certain amount of skill. If you are unsure of the suitability of a product or if you are unsure that you possess sufficient skills, please contact us for advice before ordering.

7. RETURNS

Goods will not be accepted for return unless a return authorisation number (as provided by ShipWrightShop.com) is clearly marked on the outside of the package. To obtain a return authorisation number please contact returns@shipwrightshop.com providing relevant details of the item(s) you wish to return and the reason you wish to return them.
30-day returns guarantee: If for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item, unopened (with any seals and shrink-wrap intact) and in re-saleable condition and we will issue a full refund for the price you paid for the item.
In the event of ShipWrightShop.com sending you a replacement for a damaged, defective or wrong item, you must return the damaged, defective or wrong item to ShipWrightShop.com within 30 days. ShipWrightShop.com reserves the right to charge the price of the replacement item to the payment card used for the original order if you do not return the original item to us within 30 days of the date on which ShipWrightShop.com confirms we will issue a replacement.

This returns policy does not affect your statutory rights.

8. DELIVERY TIMES

We endeavour to dispatch all orders within 3 working days, stock levels permitting.

9. DELIVERY METHODS

Please see our separate 'Postage' pages for a full listing of delivery methods.
For UK mainland deliveries, only select 'Free Delivery For Kits/Hulls' during checkout if your order contains a kit/hull from one or more of the departments 'Static Ship Kits', 'Radio Control Ship Kits' or 'Powerboat Hulls'.
If you select 'Free Delivery For Kits/Hulls' and your order does not contain a kit or hull from one of these departments your order will either not be processed or will be processed but with the correct shipping charges applied.

10. ORDER CHASING

To inquire about orders, e-mail us at sales@shipwrightshop.com giving order number and details of your order. If after 60 days from date of dispatch, the order has not been received by you and you have not notified ShipWrightShop.com of the non delivery, we will not accept any responsibility for replacing the missing goods.

11. LIMITATIONS OF LIABILITY

Nothing in these Terms and Conditions shall limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) under section 12 of the Sale of Goods Act 1979, section 2 of the Supply of Goods and Services Act 1982, or section 2(3) of the Consumer Protection Act 1987; (iii) for fraud or fraudulent misrepresentation; or (iv) for any matter for which it would be illegal for to limit or exclude, or attempt to limit or exclude, liability.
Subject to this: (i) our liability in connection with any product purchased through our site is strictly limited to the higher of the purchase price of the relevant product and the replacement cost of the relevant product; (ii) we accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable; and (iii) we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions caused by events outside our reasonable control.

12. RETENTION OF TITLE

All goods remain the property of ShipWrightShop.com until payment in full, including postage costs, is deposited in our bank account.

13. VALIDITY AND AMENDMENTS TO THE TERMS AND CONDITIONS

We reserve the right to make changes to our website, and these Terms and Conditions at any time. You will be subject to the policies and Terms and Conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

14. NO VARIATION OR REPRESENTATION

Nothing said by our sales personnel shall amount to a variation of these Terms and Conditions or a representation about the nature or quality of our products.

15. GOVERNING LAW AND JURISDICTION

These Terms and Conditions will be governed by and construed in accordance with the laws of England. Any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England.
